I acknowledge that kayaking has inherent risks, hazards, and dangers for anyone which cannot be eliminated, particularly in a wilderness environment. I understand that these risks, hazards, and dangers include without limitation: (a) water hazards in boating, kayaking, or wading in the lakes and rivers may result in bodily injury or illness including drowning; (b) injuries or illness may be caused by the negligence of the owners or employees of Crystal Clear Connections LLC DBA Crystal Clear Adventures or other participants, hiking in rugged terrain, encounters with wildlife, temperature extremes, inclement weather conditions, and unavailability of immediate medical attention in the wilderness in case of injury.

I understand the risks, hazards, and dangers of kayaking and related activities, and that these activities may require good physical condition and a degree of skill and knowledge. I believe I have this good physical condition and the degree of skill and knowledge necessary for me to engage in these activities safely. I understand that my participation in this activity is purely voluntary. I knowingly and freely assume all risk, both known and unknown, including any risk arising for the negligent acts or omissions of others and assume full and complete responsibility for my participation. No one is forcing me to participate and I elect to participate in spite of the risks. I certify that I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITIES OF Crystal Clear Connections LLC DBA Crystal Clear Adventures WITH FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS, AND DANGERS INVOLVED AND HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, PARALYSIS, OR DEATH.

I, on behalf of myself, my personal representatives and my heirs, successors, executors, and subrogates, hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY AND HOLD HARMLESS Crystal Clear Connections LLC DBA Crystal Clear Adventures, their directors, contractors, agents, employees, and volunteers from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys' fees) which are related to, arise out of, or are in any way connected with my participation in this activity including, but not limited to, NEGLIGENCE of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of my engaging in these activities or the use of any equipment, whether such damage, loss, injury, paralysis, or death results from negligence of Crystal Clear Connections DBA Crystal Clear Adventures or from some other cause. I, on behalf of myself, my personal representatives and my heirs, my successors, executors, and subrogates, further agree not to sue Crystal Clear Connections LLC or Crystal Clear Adventures as a result of any injury, paralysis, or death suffered in connection with my use and participation in these activities.

I HAVE CAREFULLY READ, FULLY ACKNOWLEDGE, CLEARLY AND COMPLETELY UNDERSTAND, AND VOLUNTARILY SIGN THIS WAIVER/RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT.

I HEREBY EXEMPT AND RELIEVE CRYSTAL CLEAR CONNECTIONS LLC AND CRYSTAL CLEAR ADVENTURES FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.

This form must be completed by every participant prior to the tour.
